Acceptance of Terms & Conditions:
Thank you for using gear6.in. The following Terms & Conditions (here within refered to as "terms") are intended to let you know of your legal rights and responsibilities in using gear6.in's website www.gear6.in (here within refered to as "website") and any other related mobile and software applications (here within refered to as "app").
"Service Provider" or "Service Center" or "Vendor" shall mean the entity that is listed on the website for providing various services within its potential as per the needs of the customer.
"Customer", "User", "Client", "You" or "Your" refers to you, who avails the services of gear6.in through its registered website and app for the purpose of repairing your vehicle including but not limited to general servicing, repairs, breakdowns, puntures, accidental emergnecies.
"gear6.in", "Us" or "Company" shall mean NewEin Technologies Private Limited, registered under Section 7 of the companies act 2013 and having its registered office at Villa K, Savoy Villas, Thubarahalli Bus Stop, Bangalore, Karnataka, India - 560066, which expression shall, unless it be repugnant to the content or meaning thereof, mean and include all its affiliates, successors and permitted assigns.
"Service(s)" shall mean any and all kinds of vehicle repair services listed and provided through the website and the app including but not limited to motorbike services and also the information provided by us on the website or the app regarding the various service providers.
"Vehicle" refers to motorbikes, Scooters and Mopeds with a valid registration ID, registered under the Motor Vehicles act 1988.
"Account" shall mean the account created by/for the customer on the website or the app to avail the services.
"Order" shall mean the request for a service placed by the customer through the website or through the app on a particular date.
"Service Executive", "Executive", "Ground Staff" shall mean the person from gear6.in, that will be assigned to the particular order to carry out the particular order from picking up of the vehicle until the delivery of the vehicle.
"Job Card" shall mean a digitized document that will be filled on the app (gear6.in executive app) by the service executive at the customer's pickup location at the time of picking up of the bike for servicing.
Eligibility to use the services:
You hereby confirm that you are at least 18 years of age and above and fully able and competent to understand the terms of this agreement.
You should have a valid vehicle registration ID along with a valid insurance certificate to avail our services. The customers without any one of the former listed documents are not eligible to book our services.
Use of Account and Services by the Customer:
gear6.in provides you with the convinience of getting your vehicle serviced without any expense of your time.
The customer upon creation of the account will be provided with a user panel to place the order for services. The customer should enter the location of pickup of the vehicle and should select the type of service from the listed services on the website. Upon the selection of the required service, the customer should choose the vehicle type, date, the service center and the time slot of service and place the order.
Our service executive will be available at the location you have provided in the time slot you have requested for the bike pickup. In the case of accidental emergencies or breakdowns, gear6.in may appoint an authorized transportation partner to transport your vehicle to the service center of your choosing or the nearest service center from the pickup location. You should be available for a call half hour before the start time of the booked time slot. You should be ready with the following documents at the time of pickup: Vehicle registration certificate, Insurance Certificate and PUC certificate. A thorough check up of the bike including but not limited to a test ride will be done at your place and the "Job Card" will be filled with all your vehicle's problems and queries. Upon the fulfillment of the job card your vehicle will be taken for the service and you will be updated on a real time basis regarding the status of your vehicle through messaging. You can also check the status of your vehicle in the user panel provided to you on the website and on the app.
Once the Service executive takes your bike to the service center, you will be updated via call or messaging or on the app regarding the estimated pricing for that particular servicing and all the repairs that will be done in that estimated pricing. Upon your approval on the estimated pricing, our service executive will be giving a go-ahead for the service at the service center.
You are solely responsible for maintaining the confidentiality of your account details and will be liable for all activities and transactions that take place under your account, whether initiated by you or any third party. We shall not be liable for the loss of any information or such by a third party accessing your account with or without your knowledge.
gear6.in provides a platform to connect the customer to the service center and holds no responsibility of the quality of the service provided by the service center. The quality of the service is solely dependent on the service center of the customer's choosing. However, gear6.in will assist and help in resolving any issues that arises post-servicing only on the services that have been carried out in that particular order.
Service Providers and Price Estimations:
The Service providers listed on our website are Authorised dealers of various vehicle brands and multi-branded service centers. The information that we disclose on the website and the app about the service centers, is based on the information provided to us by the service centers. The service centres are given a vendor panel through which they are fully responsible for updating all the offers, availability of time slots and other information which is displayed on our website.
Price Estimations for general servicing: Upon the booking of an order on our website or the app and prior to the confirmation of the order, you will be shown a basic amount as an estimate for that particular servicing. This pricing information is derived from the past orders of that particular service center and is presented to you after the confirmation from the service center. However this amount is subjected to change. A proper estimate of the pricing will be provided to you once our service executive takes your bike to the respective service center. Your order will be processed only after your approval for the estimated pricing and the repairs under that pricing.
Price Estimations for the rest of the services (Including but not limited to repairs, replacements, accidental emergencies, breakdowns): Upon the confirmation of an order on our website or the app, your order will be booked with a zero charge or a minimal charge. This means that the price estimate of that particular service(s) will be provided to you once our service executive takes your bike to the respective service center. Your order will be processed only after your approval for the estimated pricing and the repairs under that pricing.
You will be charged with a nominal convenience fee from gear6.in apart from the service center charges. This fee will be reflected in the final invoice provided by gear6.in. The fee can be calculated on the review page at the time of placement of order. However it's only an estimated calculation. The actual fees would be calculated depending on the total distance travelled by our executive for the service of your bike and the condition of your bike. Gear6.in takes the liberty to charge the convenience fees as per the effort we keep to get your order processing done.
Payment and Invoicing:
As soon as your vehicle is ready for delivery after the repairs, our service executive will intimate you via call or messaging the total payment to be done for that particular order. A proforma invoice for the order including our convenience fee will be sent to your registered email ID prior to the delivery of the bike. You are expected to make the payment against that proforma Invoice prior to the delivery of the bike via the following payment methods:
Cash Payment: The payment for the order can be made via cash on delivery to our service executive at the time of delivery of the bike.
Online Payment: You have the flexibility to make the payment online against the provided proforma invoice. You are expected to make the payment well before your vehicle has been delivered to you if you choose this option. Any additional charges that incur at the time of payment via this method will be levied on the customer. In the case where the total order value exceeds INR 3000 and the customer chooses to pay via Online Payment, the payment gateway charges as applicable will be levied on the customer.
gear6.in will generate an invoice post payment and the soft copy of the same will be sent to your registered email ID within 48 working hours of the receipt of the payment.
Cancellation and Rescheduling Policy:
The order once placed can be cancelled by calling our customer care executive on +919494845111 before 6PM on the day prior to the service date. Cancellation on the day of service will attract a cancellation fee that has to be paid by the customer. The order once placed can be rescheduled to a different date and time slot. In case of any rescheduling of the order, you have to intimate our customer care via call before 6PM on the day prior to the service date. Rescheduling on the day of service will attract a rescheduling fee that has to be paid by the customer.
If gear6.in in any case has any reason to believe that the customer has violated the terms of the service listed in this document, gear6.in reserves the sole right to cancel the customers order without any prior notice to the customer.
We shall not be liable for any failure to perform any obligations under this User Terms, if the performance is prevented, hindered or delayed by a Force Majeure Event and in such case our obligations under this User Terms shall be suspended for so long as the Force Majeure Event continues.
By accepting these User Terms and using the Service, You agree that You shall defend, indemnify and hold gear6.in, their affiliates, their vendors, and each of their officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) Your violation or breach of any term of these User Terms or any Applicable Law or regulation, whether or not referenced herein; (b) Your violation of any rights of any of our vendors (c) Your use or misuse of the Application or Service.
Intellectual Property Ownership:
The page, page code, and any and all copyrights, trademarks, service marks, trade names and all other intellectual property or material or property rights herein are proprietary to the Company and are owned by the Company and/or its licensors and content providers, and are protected by applicable domestic and international intellectual property laws. The depiction of such proprietary content does not permit or allow any user or person (whatsoever) to make any use of the same without prior written permission of the Company in any manner or reference or context.
Modifications of the Service and Terms:
gear6.in reserves the right, at its sole discretion, to modify or replace any of these User Terms, or change, suspend, discontinue or restrict your use to all or any feature of the Service or Application at any time by posting a notice on the Site or by sending You notice on your registered mobile number and email ID. Your continuous use of the Application/ Site after such notification shall be deemed to be acceptance of the revised terms by You.
Applicable law and Dispute Resolution:
These User Terms are subject to the laws of India. Any dispute, claim or controversy arising out of or relating to these User Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Site, the Service or the Application (collectively, "Disputes") will be subject to the exclusive jurisdiction of courts in Bangalore, India.
